I, Samuel Smith of State of Tennessee, County of Hawkins, being in a low state of health, but of sound, disposing mind and memory, do make this my last will in manner and form as follows, to wit: First, I will my body to the dust from whence it came and my soul to God who gave it. Next, I will all debts and funeral charges be paid by my Executors hereinafter named. Next, I will to my son Samuel Smith one negro man named Jack and all my household furniture. Next, I will a child’s part to my wife Ann Smith, as the law directs, if she has not forfeited it by her conduct. Next, I will an equal division between Henry Law, Joseph Hite, and the children of Thos. Smith of all the balance of my estate. Next, I will and appoint my son Samuel Smith and James Lea of Jefferson County my Executors, and also renders reasons why I do not make an equal divide among the whole heirs, my son Samuel has tended more on me in my infirmities than any of the rest, and Henry Law, Joseph Hite and Thomas Smith has had less of my property than the rest and is poorer.     In 1800, Stephen Wood of Franklin Co. VA filed a law suit against execs
    Samuel Smith Jr. and James Lea, which is recorded in the minutes of the
    Washington District Superior Court of TN. In Stephen Wood's deposition,
    he states that in 1766, the dec'd Samuel Smith was a resident of
    Franklin Co VA, and that "many years ago Samuel Smith removed with his
    family to the State of North Carolina, now the State of Tennessee". The
    suit was over a debt for work that Stephen Wood had done for Samuel
    Smith back in 1766, for which he had not fully been paid. In their
    depositions, the executors Samuel Smith Jr. and James Lea both disavowed
    any knowledge of the debt, and Wood accused them of conspiring to cheat
    him, saying they both had full knowledge of the debt. The case was held
    over through several terms of the court, and the minutes record that
    several deposition requests had been issued in the states of Virginia
    and Georgia (no names). Then, in 1801, when Wood was charged to put up a
    bond for the costs of the suit, he did not, and the case was dismissed. -information from Tim Upton

  • Notes 
    • Although not specifically proven that Samuel Smith is a son of Samuel Smith m Grissell Coleman, here are the reasons why this appears to be true

      1. The date of his birth would make him contemporaneous with John Smith d 1820 Montgomery Co VA and Anne Smith b c 1740.
      2. Anne Smith daughter of Samuel and Grissel Coleman Smith married Stephen Wood who sued Samuel Smith Jr and James Lea after Samuel Smith m Anne Wilkinson's death, in 1800
      3. There is some census evidence that the Coleman name continued through, for example, Samuel Smith Jr who married Martha (White?)
      4. It appears based both on YDNA testing as well as some other factors that Thomas Smith who apparently died before Samuel Smith's will in 1798 is the same Thomas Smith that married Sally Jenkins. One of those factors is that hte lawsuit for Stephen Wood issued depositions in Georgia. According to the Rev War pension app for Thomas, he had been in Henry County, VA as well as had an association with William Jenkins in Pittsylvania County.
