    • In the name of God Amen, I Samuel Smith of the County of Cumberland being sick and weak of body, but of sound mind and _______ memory for which I thank God and calling to mind the unccertainty of human life and being deirous to disfuse of all such worldly estates as it hath pleased God to bless me with I give and bequeath the same manner following that is to say 1st. I desire that all my estate both real and personal be immediately sold after my decease except Let. and out of the money arising there from all my just debt and funeral expenses be paid. 2ndly after the payments of my depths and funeral expenses I give to my wife Rachel Smith Let a negro woman which is to be hers during her natural life and at her death the said Let and her future increase if any she should have to be sold and divided in manner here after named and one third of the money arising from the sale of my estate to go into the hands of my wife Rachel Smith to be used by her for her special benefit. and if there should be any money remaining after her death to go as here after named. 3rd. I have given by way of advancement to Nancy Spencer my daughter one negro girl as her full part of my estate. 4th. I have given to my daughter Jane Clayton, Amandy Ann, a negro girl as her full share. 5th. John Smith my son to his heirs fifty dollars as their full share. 6th. To Barbary Clayton heirs fifty dollars. 7th. Martin Smith, Frederick Smith, Samuel Smith, Wm. Smith and Jas. Smith an equal division of the remains of the two thirds of all money arising from the sale of my estate except the hundred dollars named. And at the death of my wife Rachel Smith for Let the negro woman and her future increase if any she should have be sold immediatley and the money arising therefrom together with the money that should be remaining in the hands of my wife at her death to be equally divided amongst Martin, Frederick, Samuel, William and Jas. Smith. hereby revocking all will or wills therefore made by me and lastly I do hereby owe tribute and appoint my friends Frederick Smith and I. H. Winfrey executor of this my last Will and Testament. In testimony whereof I have hereunto set my hand and affixed my seal this twenty-fourth day of May in the year of our Lord 1839. acknowledged in presence of us, john W. Graves, Thomas Graves.
