Chilton's widow had already remarried and signed the inventory as Elizabeth Smith. her third husband, whom she married in Feb 1728/9 was the Rev Charles Smith of Northumberland County. The heirs named in the will of George Chilton brought suit against Charles Smith and his wife on 12 Aug 1730 seeking security for the eventual delivery of their legacies but the Court dismissed the suit on 8 March 1731/2 and ordered them to pay costs. The inventory of the estate of Charles Smith, excluding that which was to descend to the residuary legatees of George Chilton, was made by Elizabeth Smith on 3 Jun 1734. Mrs. Elizabeth Smith hade her will on 8 April 1735 and left property to her grandson Charles Purcell, granddauughter Judith, wife of Edney Tapscott, and granddaughter Margaret Dameron. She placed her grandson Charles Purcell under the care of William Chilton. The will was proved 14 May 1735. An inventory of her estate, including three slaves, ws returned by Edney Tapscott on 9 July 1735.
